Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and BlessUp ("we," "our," or "us") governing your access to and use of the BlessUp mobile application (the "App"). By downloading, installing, accessing, or using the App, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. License Grant

1.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a compatible Apple device that you own or control, solely for your personal, non-commercial use.

The App is licensed, not sold, to you. We reserve all rights not expressly granted in these Terms. The App, including all content, features, functionality, design, code, and intellectual property, is and remains the exclusive property of BlessUp and its licensors.

2. Description of the App

2.1 Core Functionality

BlessUp is a faith-based daily prayer application that provides the following services:

The App uses Apple's Screen Time API, Family Controls framework, Device Activity framework, and Managed Settings framework to provide app-shielding functionality. By granting Screen Time permissions, you authorize the App to:

You understand and acknowledge that this functionality requires explicit authorization through Apple's Screen Time permission system and that you may revoke this authorization at any time through your device's Settings > Screen Time > BlessUp.

2.3 No Guarantee of Results

The App is designed to encourage and support daily prayer habits. We do not guarantee any specific spiritual, emotional, psychological, or behavioral outcomes. The App is not a substitute for professional counseling, therapy, or medical treatment. References to research studies within the App are provided for informational purposes only and do not constitute medical or psychological advice.

3. Subscriptions and In-App Purchases

3.1 Subscription Plans

The App may offer the following auto-renewable subscription plans, which unlock premium features:

Subscription prices are in United States Dollars (USD). Prices in other currencies will be determined by Apple based on current exchange rates and local pricing conventions. Pricing is subject to change, and any changes will be communicated in accordance with applicable law and Apple's policies.

Payment will be charged to your Apple ID account at the confirmation of purchase.

The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.

Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase.

All payments are processed exclusively through Apple's App Store payment system. BlessUp does not collect, process, store, or have access to your payment information, credit card details, bank account information, or Apple ID credentials.

3.4 Free Trials

We may offer free trial periods for certain subscription plans. If a free trial is offered, you will not be charged during the trial period. At the end of the free trial period, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel at least 24 hours before the trial expires.

Any unused portion of a free trial period will be forfeited when you purchase a subscription to the same or a different plan.

Free trial eligibility is determined by Apple and is generally limited to one free trial per Apple ID per subscription group.

3.5 Cancellation

You may cancel your subscription at any time. To cancel, go to Settings > [Your Name] > Subscriptions on your Apple device, select BlessUp, and tap "Cancel Subscription." Cancellation will take effect at the end of the current billing period. You will continue to have access to premium features until the end of the period for which you have already paid.

3.6 Refunds

All purchases and subscription payments are processed by Apple. Refund requests must be submitted to Apple in accordance with Apple's refund policies. BlessUp does not have the ability to issue refunds directly. You may request a refund from Apple at reportaproblem.apple.com.

3.7 Restore Purchases

If you have previously purchased a subscription and need to restore it (for example, after reinstalling the App or switching devices), you may do so through the App's restore purchases functionality or through your Apple ID account settings.

5.1 Ownership

All intellectual property rights in and to the App, including but not limited to the software, design, graphics, BlessUp logo, BlessUp icon, user interface, prayer content, scripture selection and arrangement, text, trademarks, trade names, and trade dress, are owned by or licensed to BlessUp. The Bible verses included in the App are in the public domain; however, the selection, arrangement, and presentation thereof constitute our copyrightable compilation.

5.2 Feedback

If you provide feedback, suggestions, or ideas regarding the App ("Feedback"), you grant BlessUp a non-exclusive, worldwide, royalty-free, irrevocable, perpetual license to use, modify, and incorporate such Feedback without any obligation of compensation or attribution.

6. Disclaimers

6.1 "As Is" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

6.2 No Warranty of Availability

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee that the App will be compatible with all devices or operating system versions.

6.3 Screen Time Functionality

The app-shielding functionality depends on Apple's Screen Time API and related frameworks. We do not guarantee the availability, reliability, or continued functionality of these Apple frameworks. Changes to iOS, Apple's Screen Time frameworks, or your device configuration may affect the App's ability to shield or unshield applications. We are not responsible for any failure of the shielding functionality caused by factors outside our reasonable control, including but not limited to iOS updates, Screen Time permission revocation, or device-level restrictions.

6.4 Religious and Spiritual Content

The prayer guidance, scripture selections, and devotional content provided through the App are offered for personal spiritual enrichment and do not constitute religious, theological, counseling, or professional advice. You use such content at your own discretion and risk.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLESSUP, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

8. Indemnification

You agree to indemnify, defend, and hold harmless BlessUp, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of or access to the App; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (d) any claim that your use of the App caused damage to a third party.

9. Termination

9.1 Termination by You

You may terminate these Terms at any time by uninstalling the App and, if applicable, canceling any active subscriptions through your Apple ID account settings. Termination does not entitle you to a refund of any subscription fees already paid.

9.2 Termination by Us

We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

9.3 Effect of Termination

Upon termination, your license to use the App shall immediately cease. Sections 5 (Intellectual Property), 6 (Disclaimers), 7 (Limitation of Liability), 8 (Indemnification), 12 (Governing Law), and 13 (Dispute Resolution) shall survive termination.

10. Apple-Specific Terms

The following terms apply to your use of the App as downloaded from the Apple App Store. These terms are required pursuant to Apple's Developer Program License Agreement:

  1. Acknowledgment: You acknowledge that these Terms are between you and BlessUp only, and not with Apple Inc. ("Apple"). BlessUp, not Apple, is solely responsible for the App and its content.
  2. Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
  3. Maintenance and Support: BlessUp is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation to furnish any maintenance or support services with respect to the App.
  4. Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
  5. Product Claims: BlessUp, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
  6. Intellectual Property Claims: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, BlessUp, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
  7. Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
  8. Legal Compliance: You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Privacy

Your use of the App is also governed by our Privacy Policy, available at blessup.app/privacy. The Privacy Policy is incorporated into these Terms by reference. By using the App, you consent to the data practices described in the Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of laws principles. Any legal proceedings arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

13. Dispute Resolution

13.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact us at support@blessup.app and attempt to resolve the dispute informally for at least thirty (30) days.

13.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator. The seat of arbitration shall be Wilmington, Delaware. The language of the arbitration shall be English.

13.3 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND BLESSUP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and BlessUp agree, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

13.4 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights. Claims relating to Apple's rights as a third-party beneficiary may be brought in any court of competent jurisdiction.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with the Privacy Policy and any subscription terms presented at the point of purchase, constitute the entire agreement between you and BlessUp with respect to the App and supersede all prior or contemporaneous communications, representations, and agreements, whether oral or written.

14.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

14.3 Waiver

The failure of BlessUp to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms shall be effective only if in writing and signed by BlessUp.

14.4 Assignment

You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may assign these Terms without restriction. Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties and their permitted successors and assigns.

14.5 Force Majeure

BlessUp shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, Internet or telecommunications failures, or changes to Apple's operating systems, frameworks, or policies.

14.6 Modifications to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where practicable, provide notice through the App. Your continued use of the App following the posting of revised Terms constitutes your acceptance of such revised Terms. If you do not agree to the revised Terms, you must stop using the App and uninstall it.
